BEIJING, Aug. 18 (Xinhua) — The return of Taiwan to China is a result of victory in World War II and an important part of the post-war world order, Chinese Foreign Ministry spokesperson Mao Ning said Monday.

The diplomat made the corresponding statement at a regular departmental press briefing in response to a request to comment on the statements of the head of the department for foreign affairs of the Chinese region of Taiwan that after the end of World War II, the “San Francisco Peace Treaty” replaced such political documents as the Cairo and Potsdam Declarations, and under this treaty Taiwan was not transferred to the People's Republic of China.

“This distorting and misleading rhetoric once again exposes the blatant separatist nature of the Lai Qingde administration,” Mao Ning said, pointing out that a number of documents that have legal force under international law, such as the Cairo and Potsdam Declarations and the Japanese Instrument of Surrender, affirm China’s sovereignty over Taiwan.

“The historical and legal facts that prove Taiwan belongs to China are irrefutable,” the official representative noted.

The official representative recalled that on October 1, 1949, the People's Republic of China was founded, and the Central People's Government of the PRC became the sole legitimate government representing the whole of China, while the change of government occurred without changing China's legal status as a subject of international law. China's sovereignty and its ancestral territories remained unchanged. As a result, the PRC government naturally fully enjoys and exercises sovereignty over China, including sovereignty over Taiwan, the diplomat added.

According to Mao Ning, the so-called “San Francisco Peace Treaty” is an illegal and invalid document that was drawn up by some countries at the initiative of the United States after World War II, excluding China and the USSR, and was a separate peace treaty with Japan. This document violates the provisions of the Declaration of the United Nations of 1942, signed by 26 countries, including China, the United States, Great Britain and the USSR, and is contrary to the UN Charter and the fundamental principles of international law.

Therefore, everything stated in this document, including issues of sovereignty over Taiwan or the disposal of territories and sovereign rights of China, which did not sign this treaty, is illegal and invalid, Mao Ning said.

According to her, the Lai Qingde administration has completely abandoned its national position, ignores the results of the victory in the Chinese People's War of Resistance against Japanese Aggression, and shamelessly distorts the history of World War II. Rum made the corresponding statement during the opening of a photo exhibition called “Remembering the Past, Creating the Future” in honor of the 80th anniversary of the victory in the Chinese People’s War of Resistance against Japanese Aggressors and the World Anti-Fascist War.
