Beijing, November 28 (Xinhua) — China will strengthen ethical review of artificial intelligence (AI) patents to ensure the development of AI technologies complies with the law, social morality, and public interests, the State Intellectual Property Administration (SIPA) announced on Friday.

At a press conference organized by the department, senior official of the GAIS Jiang Tong said that the newly revised patent examination guidelines, which will take effect on January 1, 2026, included for the first time a special topic section on AI and big data.

The section states that the implementation of AI-related technical solutions, such as data collection and rule-making, must comply with legal requirements, social ethics and public interests, Jiang Tong added.

In addition, the guidance also clarifies the disclosure requirements for scenarios such as model building and training, and details the criteria for determining adequate disclosure, addressing potential issues of insufficient disclosure of technical solutions that may arise due to the “black box” properties of AI models.

At a press conference, another senior official of the State Intellectual Property Inspectorate, Liang Xinxin, stated that the intellectual property rights development plan for the 15th five-year period (2026-2030) will continuously deepen international cooperation and exchanges.

He added that the plan would also demonstrate China's unwavering commitment to equally protecting the intellectual property rights of both domestic and foreign enterprises, create a favorable business environment for companies of all types, and promote "dual circulation" of domestic and international markets.
